Terms of Services Jumblepad.com

Jumblepad offers the "Jumblepad.com" service in the form of software as a service over the Internet. The following terms apply to the use of Jumblepad.com. If any deviations from these conditions have been accepted in writing by Jumblepad, they are binding.

 

By using our service, you agree to these terms. Your use of our services is subject to our cookie and privacy policy. In our privacy policy, we explain how we collect, use, share and store your personal information. By clicking Join Now, Join Jumblepad, Register or a similar link or registering, accessing, or using our services (see instructions below), you agree to enter into a legally binding contract with Jumblepad- business (even if you use our service). If you disagree with this contact method ("contract" or "user agreement"), please do not click Join Now (or a similar link) and do not use the service. If you wish to terminate the contract, you can close your account at any time and stop accessing or using our services.

 

This contract applies to Jumblepad.com. Registered users of our services are our "members" (trainers or students), and unregistered users are "visitors".

 

You sign this contract with Jumblepad ("us"). For countries in the European Union (EU), mainly the three Benelux countries, we use the term "designated country".

 

If you live in a "designated country", you sign this contract with Jumblepad (Netherlands). Jumblepad (Netherlands) is then the controller of the services you provide to us and the personal data we collect or process for our services.

 

This contract applies to members and visitors.

This Privacy Policy (including our Cookie Policy and other documents we refer to in this Privacy Policy) and the updates apply to collecting, using, and sharing your personal information as a visitor or member of our services.

 

When you register with Jumblepad Services, you also become a member. If you choose not to register for our services, you as a visitor can access certain functions, for example, requesting information about our services and contacting one of our representatives.

 

We may be able to make changes to the contract.

We may revise this contract, our privacy policy and our cookie policy from time to time. If we make material changes, we will notify you through our services or other means so that you have the opportunity to review the changes before they take effect. We agree that the changes are not retroactive. If you disagree with the changes, you can close your account. After we post or send notice of changes to these terms and you continue to use our services, this means that you agree to the updated terms from the effective date of the terms.

 

This is version 2.0 of the Jumblepad.com Terms of Use. 

The last update was on July 3, 2023.

 

Article 1 Use of services

1. At Jumblepad.com, you can use an online learning environment where teachers can compile and publish digital teaching materials with a group of participants.

2.To use Jumblepad.com as a teacher and developer, you must register. After registration, you can directly log in to your account and use Jumblepad.com. Students can create an account for free that will be linked to the group or teacher in the future.

3.You must protect access to the accounts and data with a username (email) and password. Keep your password strictly confidential. Jumblepad can assume that everything in your account and profile will be done under your guidance and supervision after logging in with an email address and password. Therefore, unless you report a problem with your account to Jumblepad that only Jumblepad can resolve, you are responsible for these actions.

4. By registering on Jumblepad, you agree that we will process your data in the scope necessary to make our service available. In addition, you authorise Jumblepad to use your personal information to send you information about your services and any new services.

 

Article 2 Rules of use

1.It is prohibited to use Jumblepad.com to violate Dutch law or other applicable laws and regulations in an unauthorised manner. This includes storing or disseminating defamatory or racist information. It is up to Jumblepad to decide if this is the case.

2.It is prohibited to circumvent Jumblepad.com's security measures, prevent third parties from accessing Jumblepad.com through your account, use Jumblepad.com for any purpose other than the learning environment, commercialise or modify Jumblepad.com without permission of Jumblepad or modify the content of Jumblepad.com and related software and systems.

3.If Jumblepad believes that the above conditions have been violated or has received a complaint, Jumblepad can independently take measures to terminate the cooperation in the event of a violation, as in Articles 2.1 and 2.2. This may mean, among other things, that you are temporarily or permanently unable to access your account and the information you store there.

4.Jumblepad has the right to immediately report the established or suspected offences by taking any action that we consider essential at the time.

5.In case of violation of these conditions, Jumblepad can recover the damage from you. Because of these general terms, you indemnify Jumblepad against any third party claims arising out of any breach of these terms.

 

Article 3. Availability and maintenance

1.Jumblepad makes every effort to maintain the availability of Jumblepad.com but does not guarantee that the service will never be interrupted.

2.Jumblepad makes Jumblepad.com active. If any maintenance is expected to result in limited availability, Jumblepad will perform this maintenance whenever possible when Jumblepad.com usage is relatively low or on weekends. If possible, we will announce maintenance in advance. We can carry out maintenance related to disasters at any time. This is not announced in advance.

3.Jumblepad may change the functions of Jumblepad.com from time to time. Your feedback and suggestions are welcome, but in the end, Jumblepad will decide whether to make the adjustments.

 

Article 4 Intellectual property

1.Jumblepad.com, the associated software and all information and images on the website are the intellectual property of Jumblepad. Without Jumblepad's prior express written permission, this content may not be copied, modified, or otherwise used in any way, except as permitted by law.

2.The information that you store or process through our software remains yours (or your school institution). You grant Jumblepad the right to use this information in a completely anonymous manner, without specifying the source, to improve Jumblepad.com and Jumblepad related services. You can revoke this right of use by removing relevant information from your account and/or terminating the agreement with Jumblepad.

3.By submitting information to Jumblepad, such as feedback on errors or suggestions for improvement, you authorise Jumblepad to use it on Jumblepad.com. This does not apply to information that you have marked as confidential.

4.Jumblepad will not recognise the data you store and/or distribute through Jumblepad.com unless required for a quality service or following legal regulations or court orders. In that case, Jumblepad will do its best to limit knowledge of the data.

 

Article 5 Uploaded materials and code of conduct

1.You are responsible for all use materials, information, communications that you upload to the website, the materials that students who use the service upload and their compliance with these terms of use. Jumblepad assumes no responsibility and does not own the information you upload or post.

2.You accept and warrant that you will not publish, transfer, distribute or upload any material to the service that:

  • Is wrong, misleading or inaccurate.

  • Promotes or encourages illegal activities.

  • Is aimed at minorities through racial or ethnic aggression (e.g. nationality).

  • Involves defamation, assault or pornographic in any way.

  • Attacks or discriminates against sexual orientation or religious beliefs in any way.

  • Is harmful, offensive, illegal or in any way infringes the rights of any third party (including but not limited to copyrights and trademarks).

 

In addition, you accept and warrant that you will not allow third-parties to:

  • Use service transmissions that contain viruses, Trojan Horses, corrupted data, malicious software or programs

  • Distribute or copy all or any portion of the service.

  • Modify, separate, or decompile any part of the service unless expressly permitted by mandatory law.

  • Use software that automatically reads and/or collects data from the "service".

  • Use the service to solicit or encourage other users to violate the rules in these terms of use.

  • Use or misuse the service for unauthorised or illegal purposes (use of services that distribute viruses on the website or in any way infringe the rights of others).

 

The service allows you to send messages to other users. You are responsible for all messages you send through the service and you promise not to send messages that violate these terms of use and harass or threaten other users. Please note that you cannot enter any sensitive data (unique category data) in text fields that may contain www.jumblepad.com. Examples of such data or information may include but are not limited to figures, notes or comments about an individual's social or medical condition or development/progression. If you have any questions about sensitive data or special categories of data, please send an email to info@jumblepad.com. If you receive messages, images or other material that you believe may violate these Terms of Use or if you believe that the Services are being used for illegal purposes or for purposes that do not comply with these Terms of Use, please Contact Us via info@jumblepad.com.

 

Jumblepad reserves the right to immediately remove any content from the website that, in its sole discretion, it considers not in accordance with the terms of use or policies published on the website or is otherwise harmful to Jumblepad or its users.

 

Article 6 Fees for Jumblepad.com

1.The agreed fee for using Jumblepad.com as a trainer/teacher must be paid to Jumblepad regularly (monthly or once a year).

2.Currently, payment can only be made by bank transfer or according to our payment instructions sales department.

3.Because the Service is delivered immediately and provided at your request, it is impossible to withdraw payment by calling the "Long Distance Sales Act".

 

Article 7 Liability

1.Except through willful or gross negligence, Jumblepad's liability is limited to the amount you paid within three months prior to the harmful event.

2.Jumblepad is not liable for damage caused by indirect damage, data loss, indirect loss, lost profit, missed savings and (business) stagnation.

3. A condition for any right to compensation is that you receive written compensation within two months of it being discovered and confirmed on Jumblepad.

4. In case of force majeure, Jumblepad is not responsible for compensation for the damage caused to you. Force majeure also includes the failure of the Internet, telecommunications infrastructure, power failure, civil traffic, mobilisation, war, transport interruption, strikes, shutdowns, business interruptions, stagnation of the supply, fires and floods.

 

Article 8. Duration and cancellation

1.These terms apply as soon as you use Jumblepad.com and they remain in effect for as long as you continue to use them. The application of these terms and conditions can only be terminated when you stop using your account and Jumblepad.com.

2.If you have not logged in for eighteen (18) months, Jumblepad has the right to unilaterally terminate your account. In that case, we will first send a reminder email to the email address associated with your account.

3.You can request data stored or processed via the service at any time via the service desk. This service is offered one (1) time per year for free. If you request data several times a year, we charge a fee of 25 euros. Mail to for the details to info@jumblepad.com.

 

Article 9 Changes to conditions

1.Jumblepad can adjust the conditions and prices at any time.

2.Jumblepad will announce changes or additions via the service no later than fourteen days before the service starts so that you can register them.

3.If you do not wish to accept changes or additions, you can cancel the agreement in the interim terminate. Use of the Service after the effective date constitutes acceptance of the revised or supplemented terms and conditions.

 

Article 10 Other provisions

1.Dutch law applies to this agreement.

2.Any dispute arising out of the use of Jumblepad.com or these terms and conditions will only be submitted to the competent court in Jumblepad's place of business.

3.Unless you provide the contrary, the version of the communication, or information, is stored by Jumblepad, considered correct.

 

If the conditions in these terms of use prove invalid, this will not affect the validity of other agreements. In the event of new parties, these parties will determine the new settlement as an alternate, to the extent possible in accordance with the intent of the original invalid settlement.

 

Jumblepad has the right to transfer its rights and obligations under the agreement to a third party.
